The violence against women in Ciudad Juárez has made "femicide" an analytical category suitable for explaining the state of unpunished patriarchal violence perpetrated by a macho society. Is it reasonable to think that, confronted with such violence, the Mexican state must assume the consequences of an international offense? Insufficient preventive measures and serious irregularities in the investigative and procedural process, in fact, denounce the failure to respect the obligation of the State to prevent, investigate and punish human rights violations with due diligence. Therefore, if the conditions exist for defining the state "unwilling" and "unable" to genuinely prosecute the crime, are these cases on which the International Criminal Court can exercise its jurisdiction?
