This volume constitutes the natural development of the theoretical conclusions the author has reached in a previous publication, dedicated to the transition from the prohibition on a mandate to party mandate. The analysis of the provisions of the Spanish legal system on the subject of parliamentary parties and groups, and in particular of those aimed at countering the phenomenon of parliamentary hyper-mobility, confirms that it is possible to derive from traditional principles on political representation meanings that are more consistent with the peculiar role played by parties in current representative democracies, without thereby undermining their foundations. Hence the need to define legislative solutions of various kinds - constitutional, legislative, regulatory, conventional - aimed at ensuring the respect by the elected of the party mandate received by the voters.
