The essay intends to demonstrate that, beyond any polarising approach to the subject of opposing interpretative theories, it is the structure of the single norm that each time authorises interpreters to leave room for their cultural heritage and values or, instead, binds them to an ‘aseptic’ and ‘faithful’ application of legal provisions. This assumption is tested in relation to different legal frameworks and institutions.
