Our constitutional legislation lends itself to a rather differentiated judgement, both in terms of performance and actuality, depending on whether one refers, respectively, to the part concerning the form of State intended as a set of purposes and inspiring values of the action of the public authorities, and as a way of posing relations between the latter and the community, to the part concerning the organization and functioning of public state powers, or to the part concerning the form of State intended as the way in which the relations between the State and the decentralized authorities are established. Moreover, the judgement on the performance and topicality of the legislation relating to the first of the afore-mentioned parts is particularly relevant for the purposes of assessing the performance and topicality of the constitutional regulations as a whole.

Giusto Puccini is Full Professor at the University of Florence and supervisor of the courses of Public Law Institutions and Regional and Local authorities law. He is a member of the editorial staff of the electronic magazine "Osservatorio sulle fonti", and editor of the section the magazine dedicates to the legal acts of the independent administrative authorities. His scientific work has mainly been focused on the role of independent authorities, the regulatory power of the government and on regional autonomy, as well as on constitutional reforms. He has recently published the essay La riforma del bicameralismo in Italia nella XVII legislatura: dalla relazione dei “Saggi” alla proposta Renzi in the online magazine "Astrid Rassegna".
